Xtremesystems doesnt have anything to do with this. The site in question is xtremeresources (an offshoot). Hardass on their forums was the guy to move the thread to the admin section. I don't have any hard feelings towards the admins over at xtremeresources; they have been very apologetic about this whole ordeal and are just as baffled as I am. PM incoming Bill

Anyway, lets talk libel. Slander is simply the wrong term, since it refers to oral statements and gestures - kinda tough over the internet.

Bill's statements don't count as Libel, because they are insulting/offensive, but do not actually harm Liquid3D's reputation. He is free to call L3D a $#!&head to his heart's content without fear of legal action.

pHaestus is also not guilty of libel either, because a major criteria is that the defamation is false. To the best of my knowledge, none of the comments made about Liquid3D by pHaestus were false, or even particularly harmful, except to his pride.

Jurisdiction would likely be Civil Court in Los Angeles County, California, as that is where the xtremeresources Forum is hosted, or Civil Court in Houston, Texas, as that is the location of the Procooling servers (Assuming Liquid3D was pressing charges based on statements made on this site)

Again - I don't feel that legal action by either side would be particularly helpful or successful.

From PMs I have received from liquid3d I believe that he feels I am responsible for hurting his future as a hardware reviewer. I am not planning on filing any law suits at all. I for one welcome any legal action by liquid3d as it would result in a free trip to Los Angeles or Houston. When the case is dismissed then I would be entitled to court costs (air fare, hotel, and beers). Hell if the suit includes Swiftech, BillA, Cathar, Procooling (Joe), and me then maybe a few of you guys will also want to come visit!

I find my name thrown around yet again. Sure I can be rude sometimes but IMO with the Liquid3D issue it was more of a "pride being bent" issue. I re-read the threads several times and just fail to find anything I would have done different.

The net seems to be full of people who cannot handle the harshness of the REAL world. Everyone wants to be "happy happy joy joy" and expect to get that treatment even when they are completly full of shit and writting articles that are full of mis-information and just simply badly done.

I am not sorry I have little feeling for these people and cannot kiss their ass. Just isn't my thing. I am the same in the "real world" aswell but have been much more sucessfull with this "style" in the real world. I am a crew leader for a construction company and got the job because I don't take any BS. If I were to allow people to bull shit me I would not get anything usefull done on the job. I feel the same for these articles on the net. If I am to let them bull shit me then nothing usefull will get done in their articles. The only problem I have found with this theory is I can't fire anyone on the net for writting a bad article and no one seems to have the balls to do it on some of these sites or those that are in a position to fire someone dosn't have the knowledge to know they are getting bull shitted.

The net is about the only place this kind of thing would be tolerated because their is no higher power to put the hammer down. The people have to start realizing that they are the one's that need to step up and put the hammer down so a lot of this stuff stops becoming public. I feel that the people that makeup ProCooling have a similar belief as this is the reason I continue to hang around here and is now the only forum I visit. Onlytime I visit another forum is when someone links a thread were I or ProCooling gets complained about.

Liquid3D needs to understand HE is hurting his OWN future as a hardware reviewer. Not the people that call him on his ignorance/bull shit.

See now if I were to post something about someone molesting sheep for a hobby, or saying he does more drugs than a rodie for motorhead... that could be considered libel if I was talking about anyone in particular. I mean to say that some person in the 3rd dimension loves to dress up like a school girl and be fed shit sammiches while being drilled in the bum by random homeless guys... that would just go over the line.

So you can see there is a clear line here that wasn’t crossed in any of the posts on either forum :p

As an aside, I just noticed that MadShrimps seems to just slap the word "Preview" on things instead of "review". Look at the byline:

Doesnt sound like a preview really. It looks like the other reviews on the site; it is a preview until the proforums finishes critiquing it I guess?

jmke I am surprised you'd want to turn liquid3d into a martyr over this. The facts are clear:

He called the credibility of my tests and website into question
I demanded he retract those statements
He refused to do so repeatedly
He ultimately was made to see the wisdom of doing so
He then threatened legal action on me for damaging his reputation by protecting my own

It's not my fault he tried to tarnish my credibility and instead was harmed. I mean if you make shit up you have to expect that eventually it'll burn you. The question of WTF would someone go off the rails like this has come up. It is proposed that l3d made this up because he is angry at Cathar for not giving him a free Cascade, and of course at me for impuning his language skills and writing. The posts he's made seem to be consistent with this but I don't honestly know what would make him act the way he has. In any case, there's a pattern here of twisting reality to suit his purposes. From this mfgrs could readily draw their own conclusions about liquid3d. MANY water cooling mfgrs read this forum (not just the ones who register and post here). liquid3d made his bed and now can lie in it as far as I am concerned.
