Default Babe Site Discussion.

Any lawyers in the house?

There seems to be some intrest in babe/porn sites around here. I made a few babe sites in the past but always get hung on the legal issue of copyrights when posting pics. I don't have the cash to pay for legal advice nor lawsuit bills so I dropped the sites all together.

Question is how ilegal is it to post copyrighted pictures in a NON profit situation? I see places like http://www.babes.ituned.com/ and wonder how they get away with it.

I certainly have the resources to re-do the site but would be interested in your opinions on if it is a good idea or not.

I got to go to Minnisota untill the 20thish and may not have internet access untill I get back so if I don't reply don't worry.

Pretty much what I have came up with and why I killed the site. Not sure how iTuned babes gets away with it though. Maybe no one has bothered challenging them yet.

Guess I could "buy" the content and throw some ads on to help pay for it but not sure that is a direction I want to head.

You could take a different approach. I took a picture of a babe at Comicon and posted it on the Cut It Out thread in this forum. Perfectly legal. Perhaps if you had a sight that lets people randomly upload pictures of hotties that they took, you would be in business so to speak.

The more people with accounts submitting pictures, the more of a chance you would have of getting pictures of famous hotties...again pictures that the users took themselves.

How you would organize the site and so forth I don't know. But one way to encourage people to submit pics is to make it a free site, but one you have to register an account at in order to access the hotties. You could call it "randombabes.com" or something.

I think the site would have a chance if it was well-run. The most attractive women I have encountered or seen in my life were not famous, and in a lot of cases those gals look better than just about any of the famous ones. The famous chicks these days are lusty, not beautiful This site would have a chance of getting some pics of some genuinely beautiful women. I'm a Grace Kelly/Gene Tierney kinda guy myself, it sucks they don't make those anymore.

I have pondered this and have always had a user taken pics section but no one uploads anything. Also for a legal issue the pics of the people (even clothed) must be over 18 or you need the permission of the parent before taking the picture and signed contracts before posting them from what I understand of the new "child protection laws". Also voyeur is illegal in my state now. Anything deemed a violation of their privacy now has legal consequences. :shrug: So much for the constitution....

Then you're basically recreating a site like flashyourrack without the rating system. Not necessarily all bad... :shrug:

As far as covering your ass legally, it might be sufficient to show good faith in keeping things on the up-and-up; let the policy read that pics are to be 'submitted only with the permission of the subject', and a link on every page for someone to click and request to have a pic removed.

You could also very nicely ask one of our nicer members from a foreign country with less restrictive laws to host such a site.

What about Girls Gone Wild? Its basically the same thing, but trashy. From what I have heard, the guy who started that is getting sued by parents because some of the hotties were not legal over 18 hotties. So far none of those cases have won for the plaintiff.

To get the site really going, you need a "critical mass" of data to attract clicks and more people. That term, "critical mass," aside from its nuclear implications, is used by the video game console marketing people. They use it as a measure of when there are enough consoles to present a big enough installed base (and potential market) to attract 3rd party software houses to make games.

The way to do that of course is to launch the console with some already excellent and unique titles to sell enough consoles to begin with. It would be the same thing with a random babes site, you would have to have enough good material to attract enough eyeballs that will then feed off itself as people try to up one another. And as far as the law goes, paparazzi are legal in every state, and their voyeuristic tactics go far beyond anything potential users engage in for your site, hypothetically at least.

You of course would need to either review the pics yourself or have a committee or something that does that. One thing I would do with such a site is not have nudity. That seems counterintuitive to what the site is about, but the "market" for hottie viewing is so saturated with nudity and outright porn that you would never be noticed above the din in that market. You would have a site with discriminating media of the most beautiful women. Like I alluded to in my previous post, Grace Kelly comes to mind. In the old movie Rear Window, she is absolutely stunning. I would find her dressed far and away more alluring and appealing than say, Britney Spears naked. No one tries that angle these days, someone who did would find success I think. Especially if the site was free and not-for-profit.

Just use meta tags to avoid it showing up on google, make it members only to view the forums and then ban anyone that links it outside. Voila!

I like your ideas Hal. I been reserching the laws (being the job site is to ****ed up to work on) and I am not coming up with anything to keep from taking pictures. The laws say no upskirt or down blouse type stuff but I wouldn't do that anyway. Doesn't say anything about regular clothed pics.

The biggest hurdle is the massive amount of storage and bandwidth such a site would take. Would eventually need to run ads to help cover it.

I recreated the site a few days ago and password protected the directory to the site. I just wonder if search engine bots can get around that. Anyway a couple people already joined up and loaded the gallery with stuff. Now who would guess women are more popular than water cooling..... I guess I should try and make it member only to view...

Anyway will not post a direct link because it is essentially a free porn site.
